The use of any product, service or feature (the “Materials”) available through smartdoko.com (hereinafter referred to as “Website”) a company incorporated under the Companies Act, 2063 with its registered office at Kathmandu, Nepal (hereinafter referred to as “SmartDoko”).

For the purpose of these Terms of Use, wherever the context so requires “You” or “User” shall mean any natural or legal person who visits or uses the Website. SmartDoko allows the User to surf the Website without registering on the Website. The term “We”, “us”, “Our” shall mean SmartDoko Private Limited.

Your use of the Website and services and tools are governed by the following terms and conditions (“Terms of Use”) as applicable to the Website including the applicable policies which are incorporated herein by way of reference. Use of the Website shall subject you to the policies that are applicable to the Website. By mere use of the Website, you shall be contracting with SmartDoko Private Limited and these terms and conditions including the policies constitute your binding obligations, with SmartDoko.

As a minor if you wish to use the website, such use may be made by your legal guardian or parents on the Website. SmartDoko reserves the right to terminate your membership and / or refuse to provide you with access to the Website if it is brought to SmartDoko’s notice or if it is discovered that you are under the age of 18 years.
 
YOUR ACCOUNT AND REGISTRATION OBLIGATIONS

If you use the Website, you shall be responsible for maintaining the confidentiality of your Display Name and Password and you shall be responsible for all activities that occur under your Display Name and Password. The service of SmartDoko is accessible to its customer through website once an account has been created by providing certain information. CHARGES

Membership on the Website is free. SmartDoko does not charge any fee for browsing the Website. SmartDoko reserves the right to change its Fee Policy from time to time. In particular, SmartDoko may at its sole discretion introduce new services and modify some or all of the existing services offered on the Website. In such an event SmartDoko reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Changes to the fee policy shall be posted on the Website and such changes shall automatically become effective immediately after they are posted on the Website. Unless otherwise stated, all fees shall be quoted in Nepali Rupees. You shall be solely responsible for compliance of all applicable laws including those in Nepal for making payments to SmartDoko Private Limited.

 This is to inform and clarify that individuals (including but not limited to employees of SmartDoko and referred to as “Individuals” hereafter) may contribute articles and opinions on this Website entirely at the sole discretion of SmartDoko, in the form of “blogs”, as such term is generally understood. You hereby acknowledge and agree that these blogs constitute the opinion of the Individuals in their personal capacity, and may not represent official positions of SmartDoko in any manner. SmartDoko retains all copyright to these blogs.
 
 You may be permitted to post comments and feedback to these blogs. By doing so, you expressly agree and acknowledge to abide by the following:
 

• You shall not host, display, upload, modify, publish, transmit, update or share any information which: 
• Belongs to another person and to which you do not have any right;

You may not forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal you send to us on or through the Website or any service offered on or through the Website. You may not pretend that you are, or that you represent, someone else, or impersonate any other individual or entity.

We shall be entitled to, consistent with Our Privacy Policy as adopted in accordance with applicable law, use the content or any of its elements for any type of use forever, including but not limited to promotional and advertising purposes and in any media whether now known or hereafter devised, including the creation of derivative works that may include the content You provide. You agree that any content you post may be used by us, consistent with Our Privacy Policy and Rules of Conduct on Site as mentioned herein, and you are not entitled to any payment or other compensation for such use.

ORDER AND PRICING

GIFT CARD

• The gift card is non-returnable and non-refundable.
• If the gift card is lost or stolen, it will not be replaced or reimbursed.
• Gift card can only be used once.
• Gift card cannot be used with any other promotion or coupon code.
• Points will not be awarded when buying a gift card but it will be awarded to the person utilizing it.
• Gift card will be invalid and will not be replaced or reimbursed once it expires.
• No Service fees are charged in connection with SmartDoko gift cards.

SmartDoko prohibits the use of language that is racist, hateful, sexual or obscene in nature in a public area. LEGAL DISPUTES

You and SmartDoko agree that we'll resolve any claim or contention at law or equity that arises out of this Agreement or our services in accordance with one in all the subsections below or as we have a tendency and you otherwise agree in writing. ALCOHOL

APPLICABLE LAW AND JURISDICTION

These Terms and Conditions are governed by and interpreted under the laws of Nepal.

INDEMNITY

"You agree to indemnify and hold harmless SmartDoko, its officers, directors, employees, agents, affiliates, subsidiaries, and joint ventures from and against any and all claims, demands, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees), arising out of or related to your breach of these Terms and Conditions, your violation of any applicable law, or your infringement of the rights of any third party."

LIMITATION OF LIABILITY

SmartDoko is not liable for any direct or indirect loss or damages resulting from use or inability to use the website or services.

TERMINATION

SmartDoko reserves the right, at its sole discretion and without prior notice, to terminate these Terms and Conditions and revoke any or all rights granted to you under them. Upon such termination, you must immediately cease all access to and use of the website. In addition to any other legal or equitable remedies, SmartDoko shall have the right to immediately deactivate or delete your account, revoke all associated passwords and account identification, and deny you access to the website, in whole or in part.

Termination of these Terms and Conditions shall not affect any rights or obligations of either party that arose prior to the date of termination, including but not limited to payment obligations, indemnities, or liabilities.

You agree that SmartDoko shall not be liable to you or any third party for any termination or suspension of your access to the website. If you are dissatisfied with the website, its content, or any of its terms, conditions, rules, policies, or practices, your sole and exclusive remedy is to discontinue using the website.

SMARTDOKO REEDEM PAGE

SmartDoko Reward Points are associated to the user’s email id.

• SmartDoko Reward Points can't be transferred from one account to a different.
• SmartDoko Reward Points will solely be inclined to purchase products/deals from www.SmartDoko.com
• The expiration of the SmartDoko Reward Points can depend upon the activity it's being attributed against.
• SmartDoko reserves the correct to decide/alter/change the expiration amount of the activities at any time with or all of sudden.
• As a guest user customers won't be eligible for mistreatment of SmartDoko Reward Points.
• Once customers enroll themselves to become a member and starts purchasing the product, they can instigate racking up the members point. Customer receives 1% of Total Value in Points System, which is equal to 0.5% in monetary value.
• SmartDoko reserves the correct to increase or terminate the validity of Reward Points associated to any activity.
• Any items received as a result of “Members Reward Points” will only be exchanged if the product is damage and has been informed within the same day of delivery.
• SmartDoko has no obligation to compensate the client when the termination/expiration dates of the Reward Points.
• SmartDoko reserves the correct at any time, all of sudden, to add/alter/change/or vary any or all of those terms and conditions or to exchange, whole or partly, Reward Points feature with the other feature, whether or not just like this or not, or to withdraw it altogether.
• SmartDoko may, in its sole and absolute discretion, cancel, change, suspend, or modify any aspect of the Program and/or any Reward at any time, including the availability of any Reward, without notice.
• The use of the Reward Points by the client for redemption are deemed to the acceptance of those Terms and Conditions additionally to the reminder of the terms and conditions which the shoppers perceive and conform to be categorically certain by identical.
• SmartDoko reserves the correct to disqualify any customers from the advantages mention herein on top of. Just in case of any dishonorable activity, prosecutions are disbursed against the involved client.

RETURN POLICY

SmartDoko does not provide refunds but we will exchange the product.  In case the product is physically damaged or a certain part is missing while the product is delivered, please inform us within 24 hours for it to be replaced.

MINIMUM ORDER

The order will not get processed if the order amount is less than NRs 250.

CANCELLATION RIGHTS

Customers can cancel an order before it is shipped without being charged cancellation fees.

Any communication, business transactions, or promotional activities you engage in with advertisers (excluding SmartDoko) found on or via the SmartDoko platform—including payments and deliveries of associated goods or services—and any additional terms, conditions, or guarantees related to those dealings, are strictly between you and the advertiser. SmartDoko disclaims any responsibility for errors or omissions, inaccuracies in advertising content, or any losses or damages incurred as a result of these interactions or the presence of other advertisers on the SmartDoko platform.

Customer Comments, Reviews, Ratings

The word "Comments" refers to a wide range of material kinds, such as reviews, comments, photos, audio, video, location information, businesses in the area, and any other type of data or information. In connection with the services or products offered, this includes your comments and any content you upload, post, or send, including likes, ratings, messages, chat conversations, profile information, and any other materials shared on the SmartDoko Platform or shown in your account profile. Shared, disclosed, submitted, published, or offered comments on the SmartDoko Platform, or in any other way related to the usage of the SmartDoko Platform and Services, will exclusively belong to SmartDoko. You give the SmartDoko Parties a perpetual, irrevocable, worldwide, non-exclusive, fully paid, royalty-free, assignable, sub-licensable, and transferable license to use, publish, and display the Comments and all related intellectual property rights for any purpose, including marketing and advertising, by using the Services on the SmartDoko Platform and submitting your Comments. Copying, exhibiting, distributing, translating, reformatting, publishing, sharing, including into marketing materials and advertisements, analyzing, promoting, commercializing, producing derivative works, and permitting third-party services to do the same are all included in the word "use." Additionally, you give us permission to use the name or username linked to your comments. Additionally, you hereby irrevocably give up any moral rights or attribution claims or assertions in relation to comments made against SmartDoko, its clients, or any third-party services and their users.

SmartDoko has the right to use, reproduce, share, adapt, create derivative works from, and publish any Comments submitted for any reason, without any limitations. SmartDoko is not required to: (a) keep any Comments confidential; (b) provide compensation for any Comments or their use; or (c) reply to any Comments. You confirm that your Comments will not infringe the Terms or any third-party rights, such as copyright, trademark, privacy, or other personal or proprietary rights, and will not harm any individual or organization.

You agree that you will be fully responsible for your comments. You also confirm that your comments do not include any personal confidential secret or private information about yourself or anyone else. You also agree that your comments will not include any harmful illegal threatening or offensive content. Additionally, they should not have viruses promote political campaigns sell products or send chain letters mass emails or any type of spam. You agree not to post or send any comments that involve behavior that is not allowed. SmartDoko has the right to check not post or take down any comments made on the SmartDoko Platform. You allow SmartDoko to use the names you provide along with any comments you make and they do not have to keep this information private. SmartDoko can use the Comments in any way they want without any limits. You promise not to use a fake email address pretend to be someone else or trick anyone about where your comments come from. You are responsible for everything you say in your Comments and you agree to protect the SmartDoko Parties from any claims losses or problems that come from the Comments you post.

You confirm that you are the only author of your Comments and that you own all the rights to them or have permission from the owner to share them. Your Comments are original and not copied from any other source. You did not use any automated tools like bots to submit your Comments. You also agree that our use of your Comments as well as any use by third parties will not break any of your rights or the rights of others. Your Comments are true and correct and they do not break any laws. Moreover, if your comment is a review it shows a real experience you went through.

You accept all risks related to your Comment, including any reliance by others on its quality, accuracy, or reliability, as well as any personal information you disclose that could identify you. Although we retain the right to remove Comments, we do not oversee the actions or reviews made by our customers and cannot assure the accuracy, integrity, or quality of any Comment or content. You acknowledge and agree that the responsibility for any Comments made by customers, along with any liability arising from such content, rests solely with the customers who posted the Comment or content, and not with SmartDoko.

We maintain the authority to remove, restrict, or disable access to any Comment or content that we deem objectionable, in violation of the Terms, or detrimental to the Services or our Customers, at any time and without prior notice. In accordance with applicable law, we are not required to return any of Your Comment or content to you under any circumstances.

As a neutral platform, we do not mediate disputes; however, if a seller disagrees with a review, it is advisable for the seller's representative to reach out to the reviewer or provide a public response to clarify any potential misunderstandings. Should the seller believe that a specific customer's review breaches any of SmartDoko’s policies, they may contact us at customer.service@smartdoko.com to report the violation. SmartDoko reserves the right to remove the review at its discretion if it is found to violate the Terms or is otherwise detrimental to the Services.

CUSTOMER FEEDBACK

By submitting any ideas, suggestions, modifications, or documents related to SmartDoko's current business operations (collectively referred to as 'Feedback'), you acknowledge that (i) your Feedback does not include any confidential, proprietary, or secret information belonging to third parties, (ii) SmartDoko is not obligated to maintain confidentiality concerning such Feedback and may utilize it without restrictions, (iii) SmartDoko may have previously received similar Feedback from other customers or may be in the process of considering or developing it, and (iv) by providing this Feedback, you grant us a binding, non-exclusive, royalty-free, perpetual, global license to utilize, develop, publish, distribute, and sublicense the Feedback, while irrevocably waiving any claims or assertions against SmartDoko and its customers regarding such Feedback.

Kindly offer precise feedback regarding SmartDoko's current products; refrain from suggesting any ideas that are not permissible under SmartDoko's policies.

Despite the aforementioned clause, SmartDoko and its employees do not entertain or acknowledge unsolicited proposals, which encompass ideas for new advertising strategies, promotional activities, innovative or enhanced products or technologies, product improvements, processes, materials, marketing strategies, or new product names. Therefore, we kindly request that you refrain from submitting any unsolicited ideas, original creative works, suggestions, or other contributions (collectively referred to as "Submissions") in any format to SmartDoko or its employees.

This policy aims to prevent any possible misunderstandings or conflicts that may arise when the products or marketing strategies of SmartDoko appear to resemble ideas that have been submitted to the company. Should you choose to submit your ideas despite our request not to do so, the terms outlined below will govern your submissions, irrespective of the content of your correspondence.

You agree that: (1) SmartDoko will automatically own your Submissions and their contents without any compensation to you; (2) SmartDoko has the authority to use or distribute the Submissions and their contents for any purpose and in any manner; (3) SmartDoko is not obligated to assess the Submission; and (4) SmartDoko is not required to keep any Submissions confidential.

INTELLECTUAL PROPERTY

SmartDoko and its brand/seller partners retain all intellectual property rights to all text, programs, products, processes, technology, images, content, and other materials displayed on the SmartDoko Platform (“Intellectual Property”). Accessing or using the SmartDoko Platform does not grant any license or sub-license to this Intellectual Property. All rights, including copyright, associated with the SmartDoko Platform are owned by or licensed to SmartDoko. Any use of the SmartDoko Platform or its Intellectual Property, including copying or storing any part of it, is strictly prohibited unless you have received explicit prior written consent from SmartDoko.

You are not permitted to modify, distribute, or repost any content from the SmartDoko Platform for any reason. The names, logos, and all related product and service names, design marks, and slogans are trademarks/service marks of SmartDoko, its group companies/affiliates, or its partners and suppliers/service providers. Other marks belong to their respective owners. No trademark or service mark license is granted regarding the materials on the SmartDoko Platform. Accessing or using the SmartDoko Platform does not authorize anyone to use any name, logo, or mark in any way. Mentions of third-party names, marks, products, or services on the SmartDoko Platform, as well as hypertext links to third-party sites or information, are provided only for your convenience with express consent from the third parties and do not imply SmartDoko's endorsement or recommendation of the third party, its information, or its products or services.

The SmartDoko Platform may include third-party content (including embedded content) or links to external web pages, applications, products, and services, including advertisements and promotions (collectively, “Third Party Content”), for those interested in this information. We do not control, endorse, or investigate any Third-Party Content, and the inclusion of any link does not imply any affiliation or endorsement by SmartDoko of any site or its information. We cannot guarantee the accuracy or completeness of such content. You understand and agree that we are not liable for any Third-Party Content and have no obligation to update or review it.

SmartDoko is not responsible for the content of third-party sites and makes no representations regarding the accuracy of material on those sites. If you choose to access links to any third-party websites or services, you do so at your own risk and expense.

REPORT INTELLECTUAL PROPERTY RIGHTS INFRINGMENT

SmartDoko values the intellectual property rights of all individuals and organizations. If you believe that your intellectual property has been misused or infringed upon, please contact us at customer.service@smartdoko.com.

We will review your notice and respond in a timely manner. In accordance with relevant laws and our internal policies, we may take appropriate action and may reach out to you for further information. Please be aware that submitting inaccurate, false, or misleading claims to SmartDoko could lead to civil or criminal repercussions.

By submitting your email to customer.service@smartdoko.com, you agree to indemnify SmartDoko against any claims made by third parties related to that submission.

INFORMATION DISCLOSURE

To prevent the loss, misuse, and alteration of the information we handle, SmartDoko has implemented suitable physical, electronic, and managerial measures. While SmartDoko strives to maintain the confidentiality of your personal information, please be aware that no internet transmission can be absolutely secure. By using the SmartDoko Platform, you acknowledge that SmartDoko cannot be held liable for any disclosure of your information resulting from transmission errors or unauthorized actions by third parties.

Call Recording: We may record all calls between you and us, including those with our delivery partners, whether directly or through a third party. These recordings may be used for internal training and quality assurance purposes. By interacting with us, you consent to SmartDoko and any third-party associates recording the calls and sharing them with our authorized personnel, delivery partners, and other relevant entities for the purposes stated above.

You also agree that SmartDoko may share any data related to you, including call recordings, with its affiliated companies and/or government or regulatory authorities, should it be required by law

MISREPRESENTATION

SmartDoko accepts no responsibility for any communications not officially authorized by the company regarding offers, promotions, sales, etc. This includes, but is not limited to, any fraud or misrepresentation by third-party administrators that may lead to user loss or injury. Users should be aware that SmartDoko does not operate a call center, nor does it provide any landline, mobile number, email ID, social media channel, or any other electronic means of communication, except as outlined in these Terms. Therefore, please be vigilant against unauthorized individuals, fraudsters, or imposters who may claim to be communicating on behalf of SmartDoko.

YOU UNDERSTAND AGREE & CONFIRM

You are solely responsible for providing accurate and complete delivery details, including the recipient's name, address, and contact information. You are also responsible for making payments for all orders placed through your account, whether delivered to your own address or someone else's. SmartDoko shall not be held liable for any issues, including refund or cancellation claims, resulting from incorrect or incomplete information provided by you.

If a product delivery is delayed, failed, or returned due to reasons such as incorrect delivery details, unavailability of the recipient, or refusal to accept the order, SmartDoko bears no responsibility for re-delivery. Any additional costs incurred as a result of such failed delivery shall be borne by you.

SmartDoko strives to deliver Products/Services within the timeframe indicated when you place your order. However, please note that delivery times are subject to change without notice. Delays may occur due to factors beyond SmartDoko's control, such as availability of third-party delivery services, demand fluctuations, traffic, weather conditions, or issues related to your provided location. Situations where the customer is unresponsive or where delivery partners encounter challenges (such as vehicle issues or access difficulties) may also lead to delays.

Typically, delivery will occur when a person is available to receive the order at the address you provided. If you instruct the delivery partner to leave the order at your doorstep or hand it to someone else, you take full responsibility for the products. In such cases, you cannot claim a refund or compensation from SmartDoko for any loss, damage, or deficiency in the products or services. You acknowledge that SmartDoko is not liable for any issues arising from an unattended delivery, which could include theft, tampering, contamination, or temperature changes affecting the products.

For cash-on-delivery orders placed through your account (whether for your own address or someone else's), it is your sole responsibility to ensure the cash payment is made accurately—this means the amount paid to delivery partners should be neither less nor more than what is owed. SmartDoko will not be liable for any discrepancies in this regard.

To utilize the Services offered by SmartDoko for legitimate purposes only, You agree to use the SmartDoko Platform and its services solely for lawful purposes and in compliance with all applicable laws and regulations of Nepal.

You commit to providing accurate and truthful information whenever requested. SmartDoko retains the right to verify and confirm your submitted information and other details at any time.

If it is discovered that any of the information you provided is false or misleading (in whole or in part), SmartDoko reserves the right, at its sole discretion, to refuse registration, cancel any orders, and prohibit you from accessing its Services and other affiliated services in the future without any prior notice and without any liability to you.

You acknowledge that you are accessing the Services provided by SmartDoko and engaging in transactions at your own risk, and you should exercise sound judgment before proceeding with any transaction on the SmartDoko Platform.

Transactions on the SmartDoko Platform may incur various charges, including delivery fees, handling charges, convenience fees, small cart fees, surge charges for high demand or weather conditions, print charges, gift charges, or other fees that may apply ("Service Charges"). You will be notified of these Service Charges before placing your order at the checkout stage. By placing an order, you agree to pay for these Service Charges. Please note that Service Charges may vary between orders based on factors such as order/cart value, distance, time of day, delivery demand, real-time traffic and weather analysis, seasonal trends, and other parameters that may be applied over time. Additionally, SmartDoko may offer customers credits, discounts, promo codes, vouchers, or any other form of cashback at its discretion. SmartDoko also reserves the right to change, cancel, or discontinue these credits, promo codes, or vouchers as it sees fit.

Prior to placing an order, you confirm that you have thoroughly checked and reviewed the product description in detail. By placing an order on the SmartDoko Platform, you agree to the sale conditions outlined in the item’s description without exception.

By using the SmartDoko Platform or any related Services, you might come across content that some individuals may find offensive, indecent, or objectionable, whether or not it is explicitly labeled as such. You acknowledge that your use of the SmartDoko Platform and Services is at your own risk, and to the extent permitted by applicable law, SmartDoko and its affiliates will not be liable for any content that you may find objectionable.

SmartDoko is committed to enhancing your experience and providing valuable information. You understand and agree that the nature of the Services may necessitate changes, including the right of SmartDoko to pause, cancel, or discontinue any or all products or services at any time without prior notice. Additionally, SmartDoko may modify or alter any part of its content, products, and services on the Platform without notice.

We or the software application store offering our software may have features that automatically check for updates or upgrades. Unless restricted by your device or its settings, you agree that we, or the relevant software store, may notify you about available updates and automatically install them on your device or computer periodically. Certain updates may be necessary to continue accessing or using the Services, including fixes for any issues. Any updates or upgrades provided will be regarded as part of the Services.

In our ongoing effort to enhance the SmartDoko Platform and Services, we may conduct research and experiments on various elements, including our apps, websites, user interfaces, and promotional campaigns. Consequently, some customers may experience features differently at any given moment. This process aims to improve the SmartDoko Platform, making it more user-friendly and enhancing safety and security, as well as developing new services and features.

TERMS AND CONDITIONS FOR EMI ON CREDIT DEBIT CARDS AND SAMSUNG INSTA FINANCE

The terms and conditions outlined below (“EMI Terms”) are applicable to all transactions utilizing the equated monthly installments (“EMI”) facility from the banks listed within the system on our website and mobile app. These terms are in addition to, and not a replacement for, the existing terms and conditions that govern access to and use of the Marketplace. By choosing the EMI option, you (“You”) agree to adhere to these EMI Terms.

You may select the EMI payment method for approved purchases made on the system, as long as they comply with the value limits set by your issuing bank and are subject to the availability of the EMI facility from that bank.

It’s important to note that the EMI facility is not applicable to purchases made through Esewa net banking, prepaid payment instruments, or cash on delivery methods.

You have the option to combine products from different third-party sellers or brands on the Marketplace up to a total value of 2, 50,000 into a single transaction, which can then be converted into an EMI.

You recognize that the EMI facility is provided by the respective issuing banks, and SmartDoko is not involved in the approval, extension, pricing (including any taxes), alteration, pre-closure, closure, repayment, or any related matters concerning the EMI facility—these decisions lie solely with your issuing bank.

You also acknowledge that you are bound by the specific terms and conditions of the issuing bank offering the EMI facility and agree to reach out to that bank directly for any complaints, disputes, or inquiries regarding the EMI facility or any EMI transactions.

SmartDoko aims to present accurate EMI-related information for your purchases on the Marketplace based on the data provided by the issuing banks, displayed on an "as is" basis. You understand that the issuing banks are the definitive source of this information and agree to contact them for any clarifications or questions about the EMI facility. You accept that SmartDoko cannot be held responsible for any disputes that may arise related to the EMI facility offered by the issuing banks, including but not limited to the authenticity or accuracy of the EMI details provided to SmartDoko for display.

If you choose to cancel your order before the issuing bank has converted the purchase into EMI, you will receive a full refund. However, if you cancel after the EMI has been established and processed by the issuing bank, you will not be refunded for any associated fees or applicable taxes from that bank.

You understand and accept that SmartDoko has the right to discontinue the EMI facility on the Marketplace at any time without prior notice and to modify these EMI Terms at its discretion.

Any specific terms and conditions related to the issuing bank will be communicated to you when you take advantage of the EMI facility through a push notification, hyperlink, SMS, email, or another written format from either SmartDoko or the corresponding issuing bank.

You also acknowledge that SmartDoko is simply providing access to the EMI options from the banks and will not be held responsible for any related matters, including restructuring, refunds/returns, foreclosures, and so on.

PROMOTIONAL TERMS

These extra terms apply to promotional campaigns that may be available on the SmartDoko Platform from time to time (referred to as the "Offer"). Users who place orders on SmartDoko and meet the eligibility criteria set by SmartDoko or its partners for the specific campaign will be known as "Eligible Customers."

Offers will be available for a duration determined exclusively by SmartDoko and may be withdrawn at any time without prior notice. If the Offer has a minimum order value or is linked to specific product categories, it will be voided if the Eligible Customer returns the items, requests a refund from SmartDoko, or cancels the order for those products. Once an Eligible Customer has utilized the benefit or prize associated with the Offer, they agree that orders placed through the SmartDoko Platform cannot be returned or refunded.

SmartDoko and its affiliates will not be liable for any services provided by third parties in relation to the offer, voucher, or prize redeemed.

Eligible Customers agree to allow SmartDoko to share their contact details (“Information”) with authorized third parties to support the Offer. This Information will be governed by the privacy policies of those third parties, so we recommend reviewing and agreeing to those policies before participating in the Offer.

To benefit from the Offer, Eligible Customers must ensure their account settings on the SmartDoko Platform indicate Nepal, and their billing address must also be in Nepal.

SmartDoko reserves the right to change any of these terms at any time without prior notice. The Offer is non-transferable, cannot be exchanged for cash or other products, and may not be combined with any other offers. SmartDoko is not responsible for any errors or omissions made by third parties concerning the Offer.

The specifics of the voucher/prize/benefit will be shared with the Eligible Customer via email, message, Whatsapp, or in-app notifications. SmartDoko retains the right to exclude any Eligible Customer from the Offer and/or to modify or cancel all or part of the Offer at its discretion, without assuming any liability, if it finds that the Eligible Customer has (a) breached any of these terms, the terms and conditions of additional promotional activities, the SmartDoko Platform terms, or the Privacy Policy; (b) engaged or intended to engage in dishonest or fraudulent conduct, or acted in bad faith; (c) interfered with the entry process or the operation of the Offer; or (d) disrupted the Offer in any manner.

By participating in the Offer, Eligible Customers agree to these terms along with the specific terms and conditions related to the promotional activities provided to them. They explicitly acknowledge that: (a) SmartDoko Parties will not be responsible for any loss or damage that the Eligible Customer may experience, whether directly or indirectly, in connection with this Offer, including any theft, loss, or misuse of the Offer or associated Information; and (b) SmartDoko will not address any disputes or issues that arise between the Eligible Customer and third parties regarding this Offer.

PAYMENT’S FACILITY AND RELATED INFORMATION

All payments for orders and/or services must be made in Nepalese Rupees exclusively. The SmartDoko Platform will display the accepted payment methods during the payment process, which may include, but are not limited to, credit cards, debit cards, Esewa, Fonepay, Card on Delivery, and cash on delivery, as updated on the SmartDoko Platform over time. Please note that cash on delivery may not be available for certain orders.

To process payments, you acknowledge that SmartDoko may utilize third-party vendors and service providers, including payment gateways, to handle transactions and manage payment card information. If you are redirected to a third-party payment processor, you will be bound by their terms and conditions, and SmartDoko shall not be liable for any issues that may arise.

Regarding the payment details you provide to access the payment facility; you affirm that you are legally entitled and authorized to use such information for making payments. You will be solely responsible for any transactions conducted using your payment details, and you confirm that your use does not infringe upon any applicable laws.

The payment service offered by SmartDoko is not a banking or financial service but rather acts as a facilitator of an electronic, automated online payment system, processing payments through the existing authorized banking infrastructure and payment gateway networks as applicable.

You understand and agree that for certain payment methods, the respective issuer may impose additional charges such as transaction fees or other costs associated with processing your payment transaction.

As it is not feasible to include expiry date on all the products SmartDoko will make sure to send Fresh foods and also on FMCG products with at least three months expiry date.
